Near FM 4000 Likes Draw – Official Rules
PRELIMINARY INFORMATION: NO PURCHASE NECESSARY. The Near FM 4000 likes draw (“the draw”)
will begin on July 28 th , 2016 at 5pm GMT and end on August 4 th 2016 at 5pm GMT (“the draw
period”). All times refer to Greenwich Mean Time (“GMT”). Odds of winning depend upon the
number of eligible Entries (as defined below) received. The draw is subject to all applicable national
and local laws. This Competition is in no way sponsored, endorsed or administered by, or associated
with, Facebook. You are providing your information to Near Media Co-op and not to Facebook. The
information you provide will be used for this competition only, will not be shared with any other
party and will not be used for other purposes in future dealings with Near Media Co-op.
ELIGIBILITY: Open only to residents of the Republic of Ireland who are eighteen (18) years of age or
older as of the start of the draw period.
TO ENTER: To enter the draw, during the draw period visit the Near FM Facebook page
(www.facebook.com/nearfm) and like and comment on the post created on July 28 th , 2016 at 5pm.
You may enter once during the draw period. Multiple Entries received from any person beyond this
limit will void all such additional Entries. Entries generated by a script, macro, or other automated
means or by any means that subverts the entry process will be disqualified. Entries must be received
before August 4 th , 2016 at 5pm GMT to be eligible for the draw. Near Media Co-op’s computer shall
be the official timekeeper for all matters related to the draw. Entries that are incomplete, garbled,
corrupted, or unintelligible for any reason, including, but not limited to, computer or network
malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of
an entrant, the authorized account holder of the email address connected to the Facebook page
used to enter will be deemed to be the entrant. “Authorized account holder” is defined as the
person who is assigned to an email address by an Internet access provider, online service provider or
other organization that is responsible for assigning email addresses for the domain associated with
the submitted email address.
WINNER SELECTION AND NOTIFICATION: On or about 5 th August 2016, each of the four (4) potential
winners will be selected in a random drawing by representatives of Near Media Co-op from all
eligible Entries received during the draw period. Near Media Co-op will make two (2) attempts to
notify potential Winners firstly by answering the comment made by the potential winner, who will
then be required to answer Near Media Co-op via Facebook message to confirm the address to
which the prize shall be sent. If no answer is received through comment with twenty four hours (24)
a second communication will be sent through comment. The potential winner must reply and
inform Near Media Co-op of the postal address to which the prize must be sent within three (3) days
of the first comment being sent to them.
Noncompliance within this time period will result in disqualification, and, at Near Media Co-op’s
sole discretion an alternate potential Winner may be selected from the remaining eligible Entries. If
potential Winner cannot be reached, is found to be ineligible, cannot or does not comply with these
Official Rules, or if Prize (as defined below) or prize notification is returned as undeliverable, such
potential Winner will be disqualified and time permitting, at Near Media Co-op’ sole discretion, an
alternate potential winner will be selected in the same manner as described above. All entrants
Prizes will be sent via standard post to the address provided by the winner, Near Media Co-op
accepts no responsibility for any damage which be caused to the prize during the postal process or
for any failure of the prize to be delivered which is caused by the winner or the postal services. The
names of the four winners will be published on the Near FM Facebook page at the conclusion of the
draw.
PRIZE: Each prize winner will receive one (1) Near FM branded t-shirt. All details of Prize will be
determined by Near Media Co-op in their sole discretion. Near Media Co-op reserves the right to
substitute a Prize (or portion thereof) with a similar prize (or prize element) of comparable or
greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use
of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for
cash and is valid only for the items detailed above, with no substitution of Prize by Winner. If Prize is
unclaimed within a reasonable time after notification from Near Media Co-op, as determined by
Sponsor in their sole discretion, it will be forfeited, and time permitting, an alternate Winner may be
selected from the remaining eligible Entries at Sponsor’ sole discretion.
CONDITIONS: By entering the draw, each entrant agrees for entrant and for entrant’s heirs,
executors, and administrators (a) to release and hold harmless Near Media Co-op and each of their
respective officers, directors, and employees (collectively, “Released Parties”) from any liability,
illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused
by negligence or not, from such entrant’s participation in the draw and/or his/her acceptance,
possession, use, or misuse of Prize or any portion thereof ; (b) to indemnify Released Parties from
any and all liability resulting or arising from the draw and to hereby acknowledge that Released
Parties have neither made nor are in any manner responsible or liable for any warranty,
representation, or guarantee, express or implied, in fact or in law, relative to Prize; (c) if selected as a
potential winner, to being contacted via comment by the Released Parties (d) to be bound by these
Official Rules and to waive any right to claim any ambiguity or error therein or in the draw itself, and
to be bound by all decisions of Near Media Co-op, which are binding and final. Failure to comply with
these conditions may result in disqualification from the draw at Near Media Co-op’s sole discretion
and (e) to have their name published on the Near FM Facebook page as part of the announcement
of winners.
